Nature of the Phenomenon

The Duma is the principal body of local self-government of Nizhny Novgorod and consists of popular representatives elected by direct vote from the city's districts. The Duma is vested with powers to resolve all matters of local (municipal) significance.

To this end, it elects from among the deputies a nominal head of the city — the Mayor — and through him enters into a contract with an experienced administrator who becomes the City Manager, the hired head of the city administration.

The Duma holds the status of a legal entity, with a bank account and an official seal.

Powers of the City Duma

The City Duma of Nizhny Novgorod is vested with the following powers:

1. Adoption of legal acts establishing rules that are mandatory for compliance within the city, as well as legal acts concerning the organization of the Duma's activities.

2. Adoption of the City Charter and introduction of amendments and additions thereto.

3. Oversight of the exercise by local self-government bodies and local self-government officials of their powers to resolve matters of local significance.

4. Formation of electoral commissions on the territory of the city of Nizhny Novgorod.

5. Calling a local referendum; adoption of legal acts to implement the decisions of a local referendum.

6. Calling a vote on matters concerning changes to the city's boundaries and the transformation of the municipal formation.

7. Calling municipal elections and votes on the recall of a Duma deputy or the head of the city.

8. Calling public hearings; determining the procedure for their organization and conduct.

9. Calling assemblies and conferences of citizens (other than assemblies and conferences on matters of territorial public self-governance), determining the procedure for their calling and conduct, and reviewing appeals adopted by citizen assemblies and conferences.

Procedure for Recalling Deputies

Art. 16. Vote on the Recall of a Deputy of the City Duma of the City of Nizhny Novgorod

1. A vote on the recall of a deputy of the City Duma of the city of Nizhny Novgorod shall be held on the initiative of the population in the manner established by federal law and by the law of Nizhny Novgorod Region adopted in accordance therewith for the conduct of a local referendum, taking into account the specific features provided for by the Federal Law "On the General Principles of the Organization of Local Self-Government in the Russian Federation."

2. The grounds for recalling a deputy of the City Duma of the city of Nizhny Novgorod may only be specific unlawful decisions or actions (or inaction) on his or her part, provided these have been confirmed by a court.

3. Any citizen or group of citizens possessing active electoral rights may form an initiative group to put forward an initiative to recall a deputy of the City Duma of the city of Nizhny Novgorod, comprising no fewer than 1,000 persons.

4. The initiative group shall submit a written application to put forward the recall initiative to the City Duma of the city of Nizhny Novgorod. The application must be signed in person by all members of the initiative group, with each member's surname, first name, patronymic, date of birth, residential address, and passport series and number (or equivalent document) indicated.

5. The application of the initiative group must contain: a proposal to recall a deputy of the City Duma of the city of Nizhny Novgorod; a statement of the grounds for initiating the recall; and information about the authorized representative of the initiative group. The application must be accompanied by a copy of the court judgment that has entered into legal force and served as the basis for the recall.

6. The application to put forward the recall initiative must be considered by the City Duma of the city of Nizhny Novgorod within a period not exceeding 30 days from the date of receipt of the application.

7. Upon receipt of the application, the City Duma of the city of Nizhny Novgorod shall immediately inform the person against whom the recall procedure is being initiated and provide that person with copies of the application and the documents referred to in paragraph 5 of this article.

8. The City Duma of the city of Nizhny Novgorod shall discuss the received application at its session, with the invitation of the authorized representative of the recall initiator and the person against whom the recall initiative has been put forward, and shall adopt a legal act either authorizing the collection of citizens' signatures in support of holding a recall vote and registering the recall initiator as the person authorized to organize the signature collection, or refusing such authorization.

9. A prerequisite for calling a vote on the recall of a deputy of the City Duma of the city of Nizhny Novgorod is the submission of signatures in support of the initiative in the number established by the law of Nizhny Novgorod Region for the conduct of a local referendum.

10. The collection of signatures in support of the demand to hold a recall vote may begin from the moment the recall initiator receives the legal act authorizing signature collection, and shall continue for no more than 30 days from the date of adoption of said legal act.

11. The collection of signatures shall be organized by the recall initiator. Expenses associated with the collection of signatures shall be borne by the recall initiator.

12. Signature sheets for collecting signatures in support of the demand to hold a recall vote shall be produced by the recall initiator in the form established by the legal act authorizing signature collection.

13. The collection of signatures shall be carried out in the manner established by the law of Nizhny Novgorod Region for the conduct of a local referendum.

14. Signatures may be collected only from citizens possessing active electoral rights in the electoral district from which the deputy of the City Duma of the city of Nizhny Novgorod was elected.

15. The City Duma of the city of Nizhny Novgorod shall call a vote on the recall of a deputy of the City Duma of the city of Nizhny Novgorod within 30 days of the submission of signatures in support of the recall.

16. A deputy of the City Duma of the city of Nizhny Novgorod shall have the right to offer explanations regarding the circumstances cited as grounds for recall, including through free airtime and free print space provided by municipal mass media outlets.

17. A deputy of the City Duma of the city of Nizhny Novgorod shall be considered recalled if no fewer than half of the voters registered in the electoral district have voted in favor of the recall.

18. The results of the vote on the recall of a deputy of the City Duma of the city of Nizhny Novgorod shall be subject to official publication (promulgation).
